1. Acceptance of Terms

By accessing or using Goblet ("the Service"), operated by GOBLET SOMMELIER LLC, a New Jersey limited liability company, through our mobile application or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

You must be at least 21 years of age to use Goblet, as our service involves alcohol-related content and recommendations.

2. Description of Service

Goblet is an AI-powered wine companion that provides:

• Wine label scanning and identification using AI image analysis
• Personalized wine recommendations based on your taste profile
• A personal wine collection (your Winery) to save and rate wines
• Food and wine pairing recommendations
• AI sommelier chat (Vinum) for wine-related questions
• Portfolio tracking and winery management tools

3. Pricing & Subscriptions

Goblet’s core experience is free: every account includes 20 wine scans per calendar month (pooled across bottle, wine list, and shelf scanning), which reset on the first of each month, along with access to your Winery, Taste Profile, Compass, and Vinum.

Goblet Premium is an optional auto-renewing subscription ($5.99 per month or $49.99 per year) that removes the monthly scan cap and lifts usage limits across the app. It is sold through the app store you installed Goblet from. On iOS, payment is charged to your Apple ID through the App Store; on Android, to your Google account through Google Play. In both cases the charge is taken at confirmation of purchase and the subscription renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings or in Google Play’s subscription settings; cancelling stops future renewals but does not refund the current period. Refund requests are handled by Apple or Google respectively, under their own policies.

We do not collect or store your payment card details; billing is handled entirely by the App Store or Google Play. Prices may change in the future, and any change will apply only to renewals after reasonable notice. Fair-use limits apply to free and Premium usage alike to prevent abuse.

4. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

You may only create one account per person. Accounts created for fraudulent purposes will be terminated.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Upload images or content that you do not have the right to share
• Use automated tools to scrape or abuse the Service
• Impersonate another person or entity
• Use the Service if you are under 21 years of age
• Resell or redistribute access to the Service without our permission

6. AI-Generated Content Disclaimer

Goblet uses artificial intelligence to provide wine analysis, recommendations, and sommelier advice. This content is generated automatically and may not always be accurate. Specifically:

• Wine identification results are estimates and may contain errors
• Price estimates are approximations and may not reflect current market prices
• Food and wine pairing suggestions are based on general principles, not professional sommelier certification
• AI sommelier responses (Vinum) are informational only and do not constitute professional advice

Always exercise your own judgment when making purchasing decisions based on our recommendations.

7. Intellectual Property

The Goblet name, logo, app design, and all original content created by us are owned by Goblet and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of any content you create within the app (tasting notes, ratings, etc.). By using the Service, you grant us a limited license to use this content solely to operate and improve the Service.

8. Privacy

Your use of Goblet is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBLET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Termination & Account Deletion

You can permanently delete your account and all associated data at any time directly in the app: open the info (ⓘ) menu, go to the Account tab, and tap Delete account. You can also do it from any browser, without the app installed, on our account page, or by emailing support@gobletlive.com.

We reserve the right to suspend or terminate your account for violation of these Terms.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

12. Apple App Store

The following applies when you download or use Goblet on an Apple device. These terms are required by Apple and supplement the rest of this agreement:

• This agreement is concluded solely between you and Goblet, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support services for the app. Support is provided by Goblet at support@gobletlive.com.
• Goblet, not Apple, is solely responsible for the app and for addressing any product warranty claims, product liability claims, regulatory claims, or claims that the app infringes a third party's intellectual property rights.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Beyond that, Apple has no other warranty obligation.
• You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction in the United States.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
